Annual revenue cap
$50,000/year
No permit or inspection required for most sales. Food safety certificate required only for retail store sales. Optional ID number available (free) to replace home address on labels. Revenue cap doubled from $25,000 to $50,000 in 2022 via HB 178. SB701 (effective October 1, 2025) expanded allowed items to include refrigerated baked goods (cheesecake, custard pies, meringue pies, fresh fruit tarts). HB 535 would raise cap to $100,000 on Oct 1, 2026. Restaurants, catering, and wholesale are prohibited. In-state mail delivery only. Chocolate-covered items must use commercially produced chocolate.
