Wisconsin's cottage food rights were originally established through the Kivirist v. DATCP court rulings (2017-2023). However, in November 2024 the Court of Appeals partially reversed the earlier ruling, re-banning candies, chocolates, fudge, confections, dried herbs, and roasted coffee. The Wisconsin Supreme Court denied review in April 2025, making the ban final. Only baked goods remain fully legal with no cap; canned goods (jams, jellies, pickles) are limited to $5,000/year under the separate 'Pickle Bill.' Sales must be direct, in-person, within Wisconsin — no online sales, no mail order. No license, registration, or inspection required. Labeling recommended but not legally required. Pending legislation (2026) proposes expanding allowed items but adding a $40,000 cap.
