Extremely permissive law originally passed in 2019, expanded by SB 44 (effective June 12, 2026) which now allows potentially hazardous foods including acidified, pickled, and fermented foods with proper permits, inspection, training, and water testing. No revenue cap. Government only intervenes upon foodborne illness complaints for basic cottage food. One of the few states allowing wholesale and retail store sales. Honey and pet food require special registration permits. All sales must be within West Virginia.
