Everything you need to know about selling homemade food from your kitchen in Georgia.
Georgia went from one of the most restrictive cottage food states ($5,000 cap) to one of the most permissive in a single bill — HB 398 in 2025 removed the cap entirely, dropped the license requirement, and opened sales to restaurants and retail stores.

Annual revenue cap
No cap
HB 398 (effective July 1, 2025) transformed Georgia's cottage food law: eliminated the previous $5,000 revenue cap, removed state licensing requirements, allowed retail/restaurant sales, and made inspections complaint-based only. ANSI-accredited food handler course still required. Optional ID number available instead of home address on labels. Interstate sales status is disputed — some sources say allowed, others say prohibited. Verify with Georgia Department of Agriculture for current interstate rules.
